freedom of information 2000

under the freedom of information act the public can ask for information

obligation to publish

we have a right to information from public sectors (payed for by the tax payer)
  • fire service
  • NHS
  • police

the consequences of not adhering tot he freedom of information act is a

  • large fine
  • a grace period to make that information available to the public

data protection act 1998

personal informaton
  • bank account detail
  • religion/belief
  • health records
  • name
  • address
a company must encrypt all of your personal information to keep it safe

a company can not share your information

the consequences for not adhering tot this is potentially fined sued or even a prison sentence

this is important for pre production because if we are holding a consumers personal info it must be safe i.e
  • neflix,
  • amazon buying,
  • surveys/questionnaires

liable

A written statement about someone that is damaging to a persons reputation this is a form of defamation

this is applicable to written forms of media i.e newspaper, websites, posters etc

slander

untrue things that are said about a person that could be damaging this is a for form of deformation

this is applicable in video media i.e news interview.

this gives someone the right to something they have made i.e music and prevent someone else from using it

this protects someones work from being stolen

you can control how it is used

depending on what you make depends on how long you have the rights to the product

intellectual property

very similar to copyright.

if you create something for a company they own the intellectual properties rights 

this could be anything that you create music, painting, etc

Freedom of information act
  • Definition of what it means-  public authorities are obliged to publish certain info about therir activities and members of the public are entitled to request informa
  • Three reasons why it is important- allows people to chech up on public authorities
  • what are the consequences of not adhering to this law? – you are given an opportunity to reconsider your actions before taking any formal actions  
  • Find an example of where this legal issue was breached- in 2010 the law was breached by a council by not saying how many two consultants were paid
  • how does this law effect production companies? – it’s easier to access certain footage i.e. CCTV and allows people to remove any information about themselves  
intellectual property rights
  • Definition of what it means -intellectual property rights means someone can’t use some think you have created without your permition
  • Three reasons why it is important -supports over 55 milion American jobs, drives economic growth and competitiveness, helps to make a reliable and inform decisions on purcases
  • what are the consequences of not adhering to this law? -  criminal prosecution against the copy right infringement law.
  • Find an example of where this legal issue was breached – amazon has a paitent for one click purchase which was copied in 1999 by Barnes and Nobel
  • how does this law effect production companies? – they must get the rights to an image or piece of music for collaboration
libel and slander
·         Definition of what it means – Libel-making a negative written statement about some that could be damaging to them slander
·         Three reasons why it is important-to protect yourself from prosecution, to avoid broadcasting false information, avoid large financial loss
·         what are the consequences of not adhering to this law? – being forces to issue a formal apology and incur financial loss.
·         Find an example of where this legal issue was breached – a politician accused another politician of being involve in a child sex abuse case.
·         how does this law effect production companies? -what is said in an interview or article must be true

  • what are the consequences of not adhering to this law? – fines can be given out up to £50,000 and a jail sentence up to 10 years
  • Find an example of where this legal issue was breached-puff daddy copied stings song and puff daddy was forced to give 100% of the royalties
  • how does this law effect production companies? – work must be checked for any copyrighted material

Data protection act


3.  there is a maximum fine of £500,000 but the ICO (information comitoners office) have never issued a penalty more than £350,000, but from 25th May 2018 Penalties will reach 20 milion euros or 4% or annual global turnover (whichever is higher)

LO: Legal issues

What dose crowed funding mean

Crowd finding is where an independent film gets its revenue from the public through donations and they get rewards in return i.e. tickets to the premier. Correct

Two advantages of and independent project

You have more freedom over what goes in to the product.
You get more of the profit.
Get donations for any project
no subsisaries so the money goes all into your project.

Two disadvantages of an independent project

Less revenue meaning there is less money to spend
A smaller company will have less resourses
Can't market the project because you dont have the money
Difficult to let people know about your project and know you want funding. 
(Social media being used to let people know about your project)
